 High Court Halts Prosecution of Conrad Anangwe Maloba in Alleged $470,000 Ambulance Tender Case

A Nairobi-based advocate, Conrad Anangwe Maloba, has obtained a legal reprieve after the High Court suspended his intended prosecution over allegations involving a multi-million shilling transaction. The Milimani Law Courts stayed the criminal proceedings following a successful application by the lawyer challenging the nature of his arrest and the state’s authority to charge him.

Conrad Anangwe Maloba and his firm, Conrad Law Advocate LLP, argue that the Directorate of Criminal Investigations (DCI) and the Director of Public Prosecutions (DPP) are attempting to criminalize what they describe as a legitimate advocate-client engagement. According to court documents, Maloba maintains that he acted strictly as an escrow agent for a commercial transaction involving the sale of precious metals and was not a party to the underlying negotiations.

Justice Bahati Mwamuye issued conservatory orders protecting the advocate from:

  • Being summoned, arrested, or detained by the DCI or DPP.

  • Being photographed, processed, or arraigned pending a full hearing of his petition.

  • Any interference with his liberty regarding these specific allegations.

While the High Court has paused the case, the prosecution’s charge sheet contains serious allegations regarding a failed government tender deal. The state claims that between January and February 2026, Conrad Anangwe Maloba and others conspired to defraud an international investor of approximately $470,750.

The prosecution alleges the funds were obtained by falsely claiming the ability to secure a Kenyan government contract for the delivery of 500 Toyota Hiace ambulances. Furthermore, the state has accused the lawyer of acquiring proceeds of crime through his firm’s USD bank account.

Conrad Anangwe Maloba has raised concerns over the handling of his case, noting that details of the investigation were leaked to social media and blogs before formal charges were even prepared. He further argued that the police extended his cash bail multiple times without a formal charge sheet, which his legal team described as an abuse of the criminal justice system.

Milimani Principal Magistrate Rose Ndombi confirmed that the lower court would comply with the High Court’s directive. The criminal case remains stayed until the constitutional issues raised by Conrad Anangwe Maloba are heard and determined.
